A Tennessee man who dragged a police officer into a mob of rioters, initiating one of the most harrowing acts of violence during the U.S. Capitol attack, was sentenced on Thursday to more than seven years in prison.
Albuquerque Cosper Head declined to address the court before U.S. District Judge Amy Berman Jackson sentenced him to seven years and six months of imprisonment followed by three years of supervised release. The judge said Head was responsible for “some of the darkest acts committed on one of our nation’s darkest days.”
Head's prison sentence is six months shy of the statutory maximum in his case. It's also the second-longest so far among hundreds of cases arising from the Capitol siege on Jan. 6, 2021, when a mob of Trump supporters stormed the building as Congress prepared to certify President Joe Biden's electoral victory.
“The dark shadow of tyranny unfortunately has not gone away,” Jackson said. “There are people who are still disseminating the lie that the election was stolen. They’re doing it today. And the people who are stoking that anger for their own selfish purposes, they need to think about the havoc they’ve wreaked, the lives they’ve ruined.”
Head engaged in some of the most barbaric violence during the Capitol riot, repeatedly assaulting police officers who were guarding a tunnel on the Lower West Terrace, according to prosecutors.
Metropolitan Police Department Officer Michael Fanone was on the front lines of the battle for control of the tunnel entrance when Head grabbed him. Head yelled “I’ve got one!" as he wrapped his arms around Fanone's neck and dragged him into the crowd outside the tunnel, prosecutors said.
“He was your prey. He was your trophy,” Jackson told Head, 43.
Head restrained Fanone while other rioters beat and shocked the officer with a stun gun at the base of his skull. Fanone lost consciousness during the assault, which his body camera captured on video.
"Although Head was separated from Officer Fanone in the moments that followed, Head would have been able to hear the sound of the taser being activated again, Officer Fanone’s screams of agony, and the yells from another rioter to ‘Kill him with his own gun.
During Thursday's sentencing hearing, Fanone said the attack gave him a heart attack and a traumatic brain injury and ultimately cost him his career. He has written a book about his Jan. 6 experience and testified at a hearing held by the House committee investigating the insurrection.
“I would trade all of this attention to return to policing, but I can't do that,” he said. “And the catalyst for my loss of career and the suffering that I've endured in the past 18 months is Albuquerque Head.”
Other rioters have been charged with assaulting Fanone, including Kyle Young, an Iowa man who grabbed Fanone by the wrist while others yelled, “Kill him!” and “Get his gun!” Jackson sentenced Young last month to seven years and two months in prison.
Daniel “D.J.” Rodriguez, a California man charged with using the stun gun on Fanone, is scheduled to go on trial in February 2023. Thomas Sibick, a riot defendant from New York, is charged with stealing the officer's badge and police radio during the melee.
Head, a construction worker from Kingsport, Tennessee, was arrested in April 2021 and pleaded guilty to an assault charge in May 2022. He has a criminal record that includes approximately 45 previous arrests.
Prosecutors recommended a prison sentence of eight years, the statutory maximum sentence that he faced.
Fanone also asked the judge to impose the maximum sentence. He recalled how Head initially told him, “I’m going to try to help you out here. You hear me?” before shouting that he “got one.”
“I would ask you to show Mr. Head the same mercy that he showed me on January 6th, which, in case there's any question in this courtroom, is none,” Fanone said.
Head's attorney, Nicholas Wallace, requested a five-year prison sentence.
“There is no evidence that Mr. Head made advance plans with much effort or that he came to D.C. prepared for a battle. His series of bad decisions, as outlined above, while serious, is far from the worst conduct that day,” Wallace wrote.
Head told FBI agents that he drove to Washington to attend the “Stop the Steal” rally, where then-President Donald Trump addressed a crowd of supporters. Joining the mob at the tunnel, Head wielded a riot shield as a weapon and used a second shield to shove against Fanone and other officers, according to prosecutors.
“When Officer Fanone used his hand to brace himself on the doorframe in the midst of the struggle, Head struck the officer’s hand with his own hand, causing the officer to lose his grip on the doorframe,” prosecutors wrote.
After he pulled Fanone into the crowd, Head became separated from the officer. When others in the crowd surrounded Fanone to protect him from his assailants, Head repeatedly reached toward the officer and tried to grab him again, prosecutors said. Fanone's body camera showed him collapsing after his protectors escorted him back to the police line.
Fanone's partner tried to revive him, saying, “Come on, Mike. Come on, buddy. We’re going duck hunting soon.”
Regaining consciousness after nearly two and a half minutes, Fanone asked, “Did we take that door back?”
“The courage and sacrifice that Officer Fanone showed on that day is incredible, and we owe him a debt of gratitude for what he has lost," Assistant U.S. Attorney Cara Gardner told the judge.
Also Thursday, a man from Covington, Kentucky, pleaded guilty to assaulting, resisting or impeding officers with a dangerous weapon for entering the Capitol on Jan. 6 and discharging fire extinguishers on police, the Justice Department said.
Nicholas James Brockhoff, 21, also obtained a helmet belonging to an officer and wore it when he entered a Senate conference room from a broken window, prosecutors said. Brockhoff helped kick a door leading to another conference room, tore open a box and went through papers.
Brockhoff was arrested in May 2021 in Counce, Tennessee. He faces up to 20 years in prison at sentencing scheduled for March 24.
Approximately 900 people have been charged with federal crimes for their conduct on Jan. 6. More than 430 of them have pleaded guilty, mostly to misdemeanor offenses. Over 300 have been sentenced, with roughly half getting terms of imprisonment ranging from seven days to 10 years, according to an AP review of court records.
More than 100 police officers were injured at the Capitol. Around 20 defendants have been sentenced for assaulting police on Jan. 6, the Justice Department says

Jerry Ryals lost his job, became estranged from his wife and was shunned in his community after being charged for his role in the riot at the U.S. Capitol on Jan. 6, 2021.
Now the Trump supporter from Fort Gibson is losing his freedom.
U.S. District Judge Colleen Kollar-Kotelly ordered him to spend nine months in prison and pay $2,000 in restitution for his role in the attack. No appeal is planned.
"Mr. Ryals feels and expressed sincere remorse for his actions on Jan. 6 and has already suffered considerable consequences as a result of his felony conviction," his attorney, Jay Mykytiuk, said after the sentencing last week in federal court in Washington, D.C

A Shelbyville man charged with carrying a loaded revolver onto the U.S. Capitol’s property and striking an officer with a stolen police baton during the Jan. 6, 2021 riot has been sentenced to prison after pleading guilty to federal charges.
District Judge James Boasberg on Friday sentenced Mark Mazza, 57, to five years in prison for assaulting a police officer using a deadly weapon and carrying a firearm without a license in Washington D.C., according to online court records.
The sentencing comes after Mazza pleaded guilty to two of the 13 charges he faced after his arrest in November 2021.
Prosecutors sought a 6.5-year sentence, calling Mazza’s conduct that day “extremely violent” and pointing to a prior criminal conviction in which he battered an adolescent.
Mazza on the day of the riot brought two firearms with him, but lost his Taurus Judge with two hollow-point rounds and three shotgun shells at the Capitol. Video footage showed him in the tunnel area of the Lower West Terrace, where Mazza and many others are captured forcibly trying to break through a barrier of police officers.
The tunnel is where Mazza is said to have taken a police baton and began swinging at officers, striking one in the arm, while yelling “Get out of our house!” Mazza and other rioters were then forcibly removed from the grounds.
Two days later, Mazza filed a false police report in Indiana claiming he lost his Taurus Judge at the Hard Rock Casino in Cincinnati, court documents say. Federal investigators in court records said Mazza told them he falsely reported his gun as stolen in case Antifa found it and someone got killed with the firearm in his name.
Mazza told police during his initial interviews that if agents did arrest him, to place him in a “fed” with “three squares, a nice clean room” and health care.
Mazza will serve three years on supervised release after his incarceration.

A Memphis businessowner convicted of one felony and four misdemeanors related to the Jan. 6, 2021, insurrection at the U.S. Capitol has received a four-year sentence.

In early hearings before Bledsoe’s conviction, the bulk of the evidence against Bledsoe came from his own social media accounts, including his deleted Instagram account.
Bledsoe filmed himself entering the grounds of the Capitol the day of the riot and posted images of himself on Capitol grounds mid-riot, as did many other rioters did during the attempt to overturn the 2020 presidential election result.
Additionally, prosecutors presented a text conversation between him and his wife where he replied "good" after she alerted him of a bomb threat near the Capitol building.
One particular text drew the ire of D.C. District Judge Beryl Howell, during a preliminary hearing; Bledsoe texted his wife on Jan. 10 and said he believed elected officials would soon be dead.
"They're all going to be executed," Bledsoe said in the text.
The judge said she weighed the severity of texts Bledsoe sent to his wife against the defense's request to have the conditions of his bail modified.
Bledsoe, who was released with an ankle monitor pending sentencing, is now required to self-surrender to the Bureau of Prisons.
In the 21 months since Jan. 6, 2021, more than 880 individuals have been arrested in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including over 270 individuals charged with assaulting or impeding law enforcement, according to a news release from the U.S. Department of Justice.

The right-wing channel Newsmax has banned Lara Logan from its air after she went on a QAnon-style rant during an appearance on the network this week.
In a bizarre interview, Logan told host Eric Bolling that “the open border is Satan’s way of taking control of the world,” and later added that the world’s elites “want us eating insects [and] cockroaches” while they “dine on the blood of children.”
Newsmax rebuked Logan in a sharp statement to CNN on Thursday evening.
“Newsmax condemns in the strongest terms the reprehensible statements made by Lara Logan and her views do not reflect our network,” a network spokesperson said. “We have no plans to interview her again.”
Logan did not immediately respond to a CNN request for comment.
Logan, a former “60 Minutes” correspondent, has in recent years peddled incendiary and conspiratorial rhetoric. After her departure from CBS, Logan became a regular fixture on Fox News’ right-wing talk programs.
But she has not appeared on the network’s air after she made an outrageous comparison, drawing a parallel between Dr. Anthony Fauci and the infamous Nazi “angel of death” doctor Josef Mengele.
Logan said earlier this year that she was “dumped” by Fox News.

A federal judge on Wednesday ordered the release of emails from John Eastman, a former Donald Trump attorney, to House investigators, saying the communications were made in furtherance of a crime related to Trump’s efforts to subvert the 2020 election.
“The emails show that President Trump knew that the specific numbers of voter fraud were wrong but continued to tout those numbers, both in court and to the public,” Judge David O. Carter wrote.
“The Court finds that these emails are sufficiently related to and in furtherance of a conspiracy to defraud the United States,” he added.
Carter, who sits on the federal district court in central California, already released many of Eastman’s emails from around January 2021 to the House select committee investigating the US Capitol attack, but the two sides were still arguing over 562 additional documents from Eastman’s Chapman University email account.
For eight of the 500-plus Eastman documents the judge was examining, the judge said that the materials could be released because they fit in the so-called crime-fraud exception, which allows disclosure of otherwise privileged materials if the communications were related to or in furtherance of illegal or fraudulent conduct.
Four of the documents were from email threads discussing prospective election litigation. In them, Carter wrote, “Dr. Eastman and other attorneys suggest that – irrespective of the merits – the primary goal of filing is to delay or otherwise disrupt the January 6 vote.”
Carter’s new order cited one email where Trump’s attorneys state that “merely having this case pending in the Supreme Court, and not ruled on, may be enough to delay consideration of Georgia.”
“This email, read in context with other documents in this review, make clear that President Trump filed certain lawsuits not to obtain legal relief, but to disrupt or delay the January 6 congressional proceedings through the courts,” the ruling stated.
“The Court finds that these four documents are sufficiently related to and in furtherance of the obstruction crime,” it adds.
CNN has reached out to representatives for Trump and Eastman for comment.
Four other emails that the judge is ordering disclosed “demonstrate an effort by President Trump and his attorneys to press false claims in federal court for the purpose of delaying the January 6 vote.” Carter pointed to litigation that Trump filed challenging the election results in Georgia. The judge went on to cite a December 2020 email where Eastman said that Trump had been made aware that some of the allegations made in a early December state court election challenge were inaccurate.
According to Carter, Eastman wrote in the December 30, 2020, email: “Although the President signed a verification for [the state court filing] back on Dec. 1, he has since been made aware that some of the allegations (and evidence proffered by the experts) has been inaccurate. For him to sign a new verification with that knowledge (and incorporation by reference) would not be accurate.”
Yet Trump and his attorneys went on to file a federal lawsuit referencing the same inaccurate numbers, Carter said. The federal lawsuit Trump’s attorneys filed did not incorporate the numbers in the body of the complaint, but rather, the lawsuit included as an attachment the state court election challenge. Trump filed it, as Carter noted, without “rectifying, clarifying, or otherwise changing” the bogus fraud numbers.
The federal lawsuit filed by Trump also included that a footnote that Carter characterized as a Trump “attempt to disclaim his responsibility over the misleading allegations.” Trump said in the footnote he was only relying on the figures that that had been presented to him. “But, by his attorneys’ own admissions, the information provided to him was that the alleged voter fraud numbers were inaccurate,” Carter said Wednesday.
Carter’s findings that Trump and Eastman “knowingly” misrepresented voter fraud numbers in federal court will bolster the committee’s investigation into the former President’s election reversal gambits.
The committee has repeatedly argued that a core tenet of Trump’s plan to overturn the 2020 election results was to file frivolous lawsuits intended to delay certification of the results in key swing states. The judge’s ruling echoes that sentiment. The revelation of the emails also comes as the Justice Department as well as the local prosecutor in Atlanta have launched their own criminal probes looking at the 2020 election schemes.
Eastman must also hand over portions of materials related to his proposal for then-Vice President Mike Pence to disrupt certification of the 2020 election on January 6, 2021, the judge ordered Wednesday. Thirty-three documents were ordered disclosed in total, under the new order, which set a deadline for doing so for October 28.
Earlier this month, the committee argued that Eastman has been “consistently unreliable” as he’s tried to protect his communications from the ongoing probe and that the investigators should now get access to more emails from one of his work email accounts.

MSNBC’s Mehdi Hasan said Donald Trump’s warning to American Jews on Sunday might seem like just another wild rant from the ex-president.
But it shouldn’t be dismissed as “Donald Trump being Donald Trump” ― because the escalating antisemitic rhetoric from Trump and others on the right is part of a dangerous pattern, he said.
“These are not isolated or unconnected acts of antisemitic hate,” Hasan warned. “It’s all part of the same thing: The rising and dangerous fascism on the American right.”
Trump on Sunday complained that American evangelicals appreciate him more than Jews, while also insisting he has the “highest approval rating in the world” in Israel.
“Jews have to get their act together and appreciate what they have in Israel — Before it is too late!” he wrote on his floundering Truth Social platform.
Hasan played a series of clips of Trump’s other antisemitic comments over the years, and noted he’s not alone in the Republican Party in this regard.
And he warned where it could lead.
“Now is not the time to stay silent or to give the GOP a pass on this issue,” he said, adding:
President Joe Biden recently called out Trump’s MAGA philosophy as a kind of “semi-fascism” he said. For me, using that “semi” is a little too generous. And look, people can argue over the exact definition of fascism. Former President Donald Trump on Sunday said American Jews don’t appreciate him enough and that they need to “get their act together” and show more gratitude for his past policies toward Israel “before it is too late.”
“No President has done more for Israel than I have. Somewhat surprisingly, however, our wonderful Evangelicals are far more appreciative of this than the people of the Jewish faith, especially those living in the U.S.,” he posted on his platform Truth Social.
Trump went on to say that his approval rating in Israel is the highest “in the world” and that he could “easily” be elected prime minister there.

Republican Sen. Tommy Tuberville asserted that Democrats support reparations for the descendants of enslaved people because “they think the people that do the crime are owed that.”
The first-term Alabama Republican spoke at a Saturday evening rally in Nevada featuring former President Donald Trump, a political ally. His comments were part of a broader critique in the final weeks before the Nov. 8 election, when control of Congress is at stake, about how Democrats have responded to rising crime rates. But Tuberville’s remarks about reparations played into racist stereotypes about Black people committing crimes.
“They’re not soft on crime,” Tuberville said of Democrats. “They’re pro-crime. They want crime. They want crime because they want to take over what you got. They want to control what you have. They want reparation because they think the people that do the crime are owed that.”
He ended his appearance with a profanity as the crowd cheered.
Tuberville is falsely suggesting that Democrats promote crime and that only Blacks are the perpetrators. In fact, crime has slowed in the last year and most crimes are committed by whites, according to FBI data.
The Democratic Party has not taken a stance on reparations for Black Americans to compensate for years of unpaid slave labor by their ancestors, though some leading Democrats, including President Joe Biden, back the creation of a national commission to study the issue.
Some Republicans on Sunday struggled to defend Tuberville’s comments.

New Hampshire GOP Senate nominee Don Bolduc told supporters this week that he thinks the future of abortion rights “belongs” to Republican “gentlemen” state lawmakers, who he claims know best how to give women a voice on their reproductive rights.
During a Wednesday night town hall in Auburn, New Hampshire, Bolduc, a retired Army brigadier general, weighed in on whether he thinks abortion rights should be decided at the state level or the federal level.
“It belongs to the state. It belongs to these gentlemen right here, who are state legislators representing you,” Bolduc said, motioning to at least two Republican state representatives in the room, Jason Osborne and Jess Edwards.
Edwards, for one, voted against sidelining a bill in March that would have banned abortion upon the detection of a so-called fetal “heartbeat,” a misleading reference to cardiac activity in an embryo. That means the bill would have banned abortion after about five weeks, a point at which many people don’t even know that they are pregnant.
Bolduc went on to say that “as a man,” he thinks that women “get the best voice” on their reproductive rights when state legislators decide how to regulate them.
“That is the best way, I think, as a man, that women get the best voice: at the state level, not at the federal level,” he said.
Bolduc said his opponent, Democratic Sen. Maggie Hassan, simply doesn’t understand that the best way to regulate women’s access to abortion care is on a state-by-state basis.
“She needs to get on board with the Supreme Court decision” to end Roe v. Wade, he said.
Bolduc campaign spokesperson Kate Constantini did not respond to a request for comment on why Bolduc thinks abortion rights are best decided by Republican “gentlemen” state legislators, or why he thinks they know best how to give women “a voice” on abortion matters.

A North Carolina man pleaded guilty Thursday to plotting with other members of the far-right Proud Boys to violently stop the transfer of presidential power after the 2020 election, making him the first member of the extremist group to plead guilty to a seditious conspiracy charge.
Jeremy Joseph Bertino, 43, has agreed to cooperate with the Justice Department’s investigation of the role that Proud Boys leaders played in the mob’s attack on the Capitol on Jan. 6, 2021, a federal prosecutor said. U.S. District Judge Timothy Kelly agreed to release Bertino pending a sentencing hearing, which wasn’t immediately scheduled.
Bertino also pleaded guilty to a charge of unlawfully possessing firearms in March 2022 in Belmont, North Carolina. Kelly accepted his guilty plea to both charges during a brief hearing after the case against Bertino was filed Thursday.
Justice Department prosecutor Erik Kenerson said estimated sentencing guidelines for Bertino’s case recommend a prison sentence ranging from four years and three months to five years and three months. The Civil War-era seditious conspiracy charge carries a maximum sentence of 20 years in prison.
Former Proud Boys national chairman Henry “Ënrique” Tarrio and four other group members also have been charged with seditious conspiracy for what prosecutors say was a coordinated attack on the Capitol to stop Congress from certifying President Joe Biden’s 2020 electoral victory over Donald Trump.
Bertino’s cooperation could ratchet up the pressure on other Proud Boys charged in the siege.

The woman who said she had an abortion that Republican Senate nominee Herschel Walker had paid for in 2009 is also the mother of one of his known children, The Daily Beast reported Wednesday.
In an explosive report published by The Daily Beast earlier this week, the anonymous woman said that while she was dating Walker, now an anti-abortion candidate in Georgia, he urged her to have an abortion and then reimbursed her. She provided documents, including an image of a personal check she said he sent to repay her for the abortion.
Walker, a former college football and NFL standout, called the accusation a “flat-out lie.” On Fox News on Wednesday morning, he was asked if he knew who the woman could be. “Not at all,” he said. “And that’s what I hope everyone can see. It’s sort of like everyone is anonymous, or everyone is leaking, and they want you to confess to something you have no clue about. But it just shows how desperate [Democrats] are right now.”
It’s surprising Walker had trouble working out her identity. She’s apparently the mother of one of the children he has publicly acknowledged as his own.
The Daily Beast said the woman had proved she is the mother of one of his children.
She told the news outlet she was “stunned” by his defense.
“But I guess it also doesn’t shock me that maybe there are just so many of us that he truly doesn’t remember,” she said. “But then again, if he really forgot about it, that says something, too.”

Dunfee was expected to make his first appearance in court in the Southern District of Ohio on Wednesday.
Nearly 900 individuals have been arrested for their roles in the events of Jan. 6. The House committee investigating Jan. 6 was planning to have an additional hearing last week but postponed it due to Hurricane Ian. Members of the far-right Oath Keepers militia are currently being tried on a number of charges, including seditious conspiracy.

A Millington man is scheduled for sentencing in December after entering guilty pleas in relation to the Capitol riot in Washington, D.C. on January 6.
Ronald Sandlin, 35, pleaded guilty Friday to conspiracy to interfere with the peaceful transition of power and assaulting law enforcement officers. According to court documents, Sandlin posted to Facebook about his intent to caravan to Washington D.C. in late December and was seeking donations.
He is also alleged to have worked alongside two other men, Nathaniel DeGrave and Josiah Colt, and the three discussed shipping guns to Sandlin's home in Tennessee. Two days before the attack, Sandlin posted a picture of Colt holding a gun in bed to Facebook.
Sandlin watched the "Stop the Steal" rally at a restaurant near the Ellipse, before live-streaming a call-to-arms.
"Sandlin live-streamed a video in which he called on 'other patriots' to 'take the Capitol,'" a press release from the Department of Justice said. "In the video, Sandlin stated four times that 'freedom is paid for with blood.'"
According to the press release, the three men then went to the Capitol together, wearing face masks, helmets, and shin guards. Sandlin was alleged to be carrying a knife and DeGrave was alleged to be carrying bear spray. After climbing dismantled barricades, they entered through the upper west terrace door.
"While inside, Sandlin and DeGrave pushed against officers guarding an exterior door to the Capitol Rotunda, slowly forcing the door open and letting a mob stream inside. Sandlin shouted at the officers, 'You're going to die, get out of the way,' before later grabbing an officer's helmet," the press release said.
While in the Capitol, Sandlin stole a book from the desk of a Senate-side office, picked up an oil painting, and smoked weed in the Capitol Rotunda. The painting was eventually taken off his shoulder by other rioters.
The DOJ said Sandlin left the Capitol at about 3:16 p.m., about an hour after he and his partners entered.
Colt entered a guilty plea July 14, 2021, and DeGrave entered a guilty plea June 27, 2022. Sandlin was arrested January 28, 2021, and is slated to be sentenced on December 9 in Washington, D.C. He could face up to 28 years in prison for the charges, along with possible fines and court costs.

Rep. Matt Gaetz (R-Fla.), a Florida native and lawmaker, voted against a measure to open the Federal Emergency Management Agency up to millions of dollars in disaster relief.
Gaetz was one of several House Republicans on Friday who voted against a resolution to allow FEMA to use up to $15 million in the Disaster Relief Fund, Newsweek reported.
The bill eventually passed in both the House as well as the Senate and it awaits President Joe Biden’s approval.
The vote comes in the same week that Hurricane Ian killed dozens of Florida residents, flooded communities and destroyed homes and businesses.
Gaetz and other GOP lawmakers added their names to a letter that said they’d “do what is necessary” to stop funding the Biden Administration, according to the news site.
“Any legislation that sets the stage for a ‘lame duck’ fight on government funding gives Democrats one final opportunity to pass that agenda,” the letter said.
Gaetz is no stranger to voting against hurricane relief as the lawmaker didn’t vote in favor of a $15 billion relief package as Hurricane Irma – where at least 92 people died in the contiguous United States – approached Florida in 2017, the Miami Herald reported.
Gaetz did, however, pass a separate $7.5 billion hurricane relief bill earlier that week.
The $15 billion package was linked to a deal between Democrats and former President Donald Trump to raise the debt ceiling and fund the government until December 2017.
“Only Congress can find a way to turn a natural disaster into a trillion new dollars in spending authority,” Gaetz said at the time of the $15 billion package.
